Steps to Obtain a Restraining Order in Oregon

The most common type of restraining order in Oregon is the Family Abuse Prevention Act. Under newly revised legislation, these restraining orders require the victim to show an act of abuse within the last 180 days, that the victim reasonably fears for his or her safety, and that the perpetrator presents a credible threat to the safety of the victim or the victim’s child. Another type of restraining order in Oregon is a stalking order. This order requires two or more unwanted contacts that would alarm or coerce a reasonable person, and that cause the individual reasonable apprehension concerning the safety of themselves or member of that individual’s immediate family. A stalking order may be available between persons who do not have the required family or intimate relationship required under the Family Abuse Prevention Act. Why Choose Our Attorneys for Domestic Violence Cases

At Rose L. Hubbard, we believe that each case needs to be evaluated on its own merits. These restraining orders can provide a significant measure of protection for those who have been abused or have been the victims of stalking. On the other hand, sometimes completely innocent persons are falsely accused. We have substantial experience litigating on behalf of both the person seeking the restraining order and the person defending.
